I find that most people who are struggling with this either have the microphone too close to their face, are blowing too hard, or both. Ive kept playing around with the "flute" in the Zelda spirit tracks game. Using the 'Mic Test' in the options menu is a good way to tell if your breath is getting picked up, which is what led me to that strategy, so I'd recommend trying that to anyone having trouble. Most people are handling the spirit flute sections without any trouble at all.
I'm always getting that either my timing is off, or I miss the signal and I don't know what the signal is when it's Link's turn to play the flute, so I don't know where my mistake is. I blow on my top hole than the bottom non worked. It sucks when I can't tell if the problem is me doing it wrong, if my hardware can't handle it or if the game is just programmed to be picky about it. I think this is accurate. I can't seem to get it.

But there is one thing that is not working for me and it really bothers me. @Daveydave: I don't like how the stealth returned, as that's always the worst part of a Zelda game, I don't like how I can walk away for 5 minutes of game time and miss nothing in the train sections, I don't like how I have to lean into my DS to use the fan, and I think the puzzles that aren't in the dungeons are simply massive wastes of time, particularly if you try a brute force approach. I thought you were supposed to hold the DS up to your face so your eyes are resting on the bottom screen and you're huffing into the top of the microphone. I played the Legend of Zelda: Spirit Tracks for DS just recently and had all kinds of problems playing it on my JPN New 3DS LL due to the mic not working.
I've just given up on it...Yes, I've had terrible problems with the flute, completely unable to pass the first test. The game just didn't recognize my accent.I haven't had trouble with the pan flute until just recently. Stupid Sand Sanctuary song!
I had similar issues with the flute in Spirit Tracks on my 3DS, yet I managed to arduously struggle through to the end of it. Try with the microphone about half the distance you'd normally play.

Too close or far will screw your playing up.If you've tried it on different DSes, I'm guessing the problem is with your blowing angle.
